Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SomaForge ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 18 years old to use SomaForge. By creating an account, you represent and warrant that you are 18 years of age or older. We reserve the right to terminate accounts of users who are found to be under 18.

3. Medical Disclaimer

SomaForge is for informational and educational purposes only. It does not constitute medical advice, diagnosis, or treatment.

The App is designed for personal health tracking and should not be used as a substitute for professional medical advice. Always consult with a qualified healthcare professional before:

• Starting, changing, or stopping any medication, supplement, or health protocol
• Making decisions about your health based on data or insights from the App
• Interpreting health metrics

AI-generated content, including daily briefs, trend analysis, and health insights, is not medical advice. These features use artificial intelligence that may produce inaccurate or incomplete information. Always verify AI-generated suggestions with your healthcare provider.

SomaForge is NOT HIPAA-compliant and should not be used as a medical records system. We do not maintain Business Associate Agreements (BAAs) with our infrastructure providers.

4. Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate and complete information when creating your account
• You must promptly notify us of any unauthorized use of your account
• You may not share your account with others or create multiple accounts

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or infrastructure
• Attempt to access other users' accounts or data
• Use the App to store or transmit malicious code
• Scrape, harvest, or collect data from the App using automated means
• Use the App to provide medical advice to others
• Misrepresent your identity or affiliation

6. Subscriptions & Payments

6.1 Subscription Plans

SomaForge offers free and paid subscription tiers. Paid features require an active subscription. Current plans include Monthly and Annual options. Pricing is displayed in the App and may change with notice.

6.2 Billing

All payments are processed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. By subscribing, you agree to Apple's payment terms.

6.3 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price. You can manage or cancel subscriptions in your device's Settings > Apple ID > Subscriptions.

6.4 Free Trials

SomaForge offers a 14-day free trial for new subscribers. Free trial periods convert to paid subscriptions unless canceled before the trial ends. Any unused portion of a free trial is forfeited upon purchasing a subscription.

6.5 Refunds

Refunds are handled by Apple in accordance with their refund policy. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.

7. Intellectual Property

SomaForge, including its design, features, content, branding, and code, is the intellectual property of SomaForge and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the App without our prior written consent.

Your health data remains yours. We claim no ownership over the data you enter into the App. You retain full rights to export, delete, or transfer your data at any time.

8. Third-Party Services

The App integrates with third-party services including Supabase (data storage), Anthropic Claude (AI features), USDA FoodData Central (nutrition data), Open Food Facts (product data), RevenueCat (subscriptions), Apple HealthKit (health data sync), and Sentry (crash reporting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Health data, nutritional information, or AI-generated insights will be accurate or complete
• The App will meet your specific health or fitness requirements
• Defects will be corrected in a timely manner

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOMAFORGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or health records
• Health outcomes resulting from reliance on the App's data or recommendations
• Medication errors based on App reminders or information
• Inaccurate nutritional data or AI-generated advice
• Interruption of health tracking due to service outages

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless SomaForge from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time via Settings > Data & Privacy > Delete Account. Upon termination:

• Your right to use the App ceases immediately
• We will delete your data within 30 days unless required by law to retain it
• Active subscriptions should be canceled through Apple to prevent further charges
• We recommend exporting your data before deleting your account

13. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms. If you disagree with any changes, you should stop using the App and delete your account.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
